Ministry of Work Issues Guide and Extends Deadline for the Registration of Equality Plans

On January 19, 2024, the Ministry of Work issued Ministerial Decree No. MDT-2024-013 which contains the guidelines for the registration of Equality Plans through the digital platform of the Ministry of Work, which mainly state the following:

 

  • Minimum Parameters: Based on the results of the diagnostics, employers must draw up the Equality Plan with the minimum parameters established in the Practical Guide issued by the Ministry.
  • Specialized Committee: The Equality Plan must include a Specialized Committee or a person who will monitor, evaluate and periodically review the plan.
  • Registration: The Plan will be registered via the platform of the Ministry of Work, and a certificate of registration will be issued.
  • Validity and Distribution: The Equality Plan will be valid for four (4) years from its registration, and it must be shared and distributed among all workers under the employer’s responsibility.
  • Updates: The Equality Plan may be updated at any time; however, this will be mandatory in the cases set forth in the Equality Law.
  • Complaints, Control and Penalties: The Regional Work Directorates will receive complaints for failure to register Equality Plans and may impose fines of up to USD 200 for breach of this obligation.

 

Lastly, the Ministry of Work will receive Equality Plans in hard copy until the digital platform is enabled as of January 20, 2024. Employers will have until July 31, 2024 to submit Equality Plans.
